Legal Practitioners

Legal Practitioners are generally involved in the personal insolvency system through:
- Representing creditors seeking to bankrupt a person (or representing a debtor defending a bankruptcy proceeding);
- Providing specialist legal advice to the trustees of bankruptcies or Part Xs;
- Assisting persons whose estates are under administration in respect of Objections to Discharge, Income Contribution Assessments or other determinations or actions affecting their rights;
- Involvement in litigation by trustees seeking to recover property.
Legal Practitioners may also act as a Controlling Trustee in the setting up of a Personal Insolvency Agreement under Part X of the Bankruptcy Act. Information of s.188 Authorities and Part X can be accessed through the main section link "Part X" on the top menu bar.
Controlling Trustees have certain obligations and standards they need to meet.
